These General Terms and Conditions of Sale (GTC) govern the terms of subscription, billing, and termination of services offered by the FINCORY application (hereinafter "the Application"), accessible via Shopify. They apply exclusively to professionals who own a Shopify store (hereinafter "Merchants").
The Application is offered as a monthly subscription, billed automatically via Shopify Billing.
The Merchant acknowledges and agrees that the Application is distributed via the Shopify App Store. Consequently, subscription fees related to the use of the Application are charged and collected exclusively by Shopify International Limited (or its affiliated entities), acting as the payment intermediary.
The billing cycle, payment methods, and tax management (VAT, GST, etc.) are governed by Shopify's terms and conditions. The customer will receive their invoices directly from their Shopify admin panel.
FINCORY reserves the right to offer customized quotes.
The subscription is automatically renewed each month unless cancelled by the Merchant via their Shopify interface before the end of the current period. Any period already begun is due in full, including in the event of early uninstallation.
By default, FINCORY subscriptions are commitment-free. Merchants can cancel at any time through their Shopify account.
The cancellation will take effect at the end of the current billing period. No pro-rata refund will be issued.
Access to the Application is effective as soon as it is installed on the Shopify store and the selected billing plan is validated.
FINCORY provides a technical decision-making tool. The Merchant is solely responsible for the commercial actions they implement through the Application.
FINCORY acts as a technical service provider. The Merchant remains solely responsible for its use of the Application and any resulting commercial consequences.
FINCORY does not guarantee the results generated or the continuous proper functioning of the Application. FINCORY cannot be held liable for interruptions caused by Shopify or third-party services.
To the fullest extent permitted by applicable law, FINCORY shall in no event be liable for indirect, incidental or consequential damages, including but not limited to: loss of profits, revenue, data, goodwill or any business interruption suffered by the Merchant or third parties, even if FINCORY has been advised of the possibility of such damages.
FINCORY's liability is strictly limited to the total amount invoiced during the last three (3) months preceding the event giving rise to liability, regardless of its cause.

French law alone shall apply, to the exclusion of all other legislation. Any dispute shall be brought before the courts of Paris, unless otherwise required by law.
Installing and using the Application constitutes full and complete acceptance of these Terms and Conditions.
